The ruling was delivered  by Justice Gabriel Kolawale on behalf of the two other judges .

His ruling followed the dismissal of the application brought before the court by the former National Chairman of the PDP, Uche Secondus, to suspend the conduct of the convention pending the determination of the suit before the same court on his status in the party.

Justice Kolawale in his ruling, observed that the appellant did not challenged the decision of the party when he was  suspended by his ward and even at the state level.

Speaking to Newsmen outside the court room Counsel to Uche Secondus, Mr Tayo Oyetubo stated the application was not an abuse of court process contrary to what the Counsel to the PDP said.
