The Court of Appeal sitting in port Harcourt has fixed tomorrow to rule on the application for interim injunction filed by Former National chairman of PDP Prince Uche Secondus against the conduct of the National Convention of the Peoples Democratic party.
Counsel to Mr Secondus, Mr. Tayo Oyetubo had earlier applied for order of interim injunction against the conduct of the convention scheduled to hold on the 30th and 31st of October pending the determination of his appeal.
He argued that proceeding with the convention would permanently strip the appellant of his rights as his tenure was yet to expire.
But counsel to the 1st to 5th respondents Henry Bello opposed the application saying that attempt to stop the convention was not part of the original application which seeks to reinstate Uche Secondus as National Chairman of the Party.
Other respondents counsels who towed the same line of argument on points of law, said the application has no legal backing, lacked merit.
They also urged the court to place the convenience of over four thousand PDP delegates who are preparing for the convention above that of one man.
Consequently ,the counsels pointed out that the PDP convention was a statutory duty enshrined in the constitution and that it would amount to making an unconstitutional order if the court proceeds to grant the injunction.
They prayed the Court to strike out the application and award damages against Uche Secondus.
Speaking to Newsmen outside the court room counsel to the 1st to 5th respondents Henry Bello said after argument on the application filed by Prince Uche Secondus against the PDP , the court reserved judgement till tomorrow to determine if the convention will hold or not.
Also speaking, Counsel to Uche Secondus,Tayo said his client prayed the court to suspend the National convention of the party pending the outcome of his appeal.
On the 14th of October 2021, the appellant had filed an appeal against the judgement of the State High Court delivered on the 10th of September 2021 which restrained Uche Secondus from performing the functions of the office of National Chairman of PDP.
