Court strike out late Chima Ikwunado case

A Federal High court sitting in Port Harcourt have struck out the two defective fundamental human rights suits filed by family of late Chima Ikwunado. The two suits which were filed by Chima’s father, Kevin Ikwunado and Wife Adaugo were struck out on the request of their lawyer, Princess Lawrence . Mrs. Lawrence while arguing her application for the withdrawal told the court that she has more facts as such needed time to amend the earlier suits brought before the court. Justice J.K. Omotosho shortly after hearing the arguments of the lawyers in the matter struck out the case but declined to dismiss it as requested by lawyers to the Police, Sokari Egop and Alibi Jonah. Justice Omotosho in his ruling on the two applications said he refused to dismiss the suit because lawyers to the police have not joined issues in the case. He said the police lawyers failed to file within the five days response time known by law. The suit was filled against the Nigeria Police Force, Rivers State Commissioner of Police and Commander E-Crack . Our Correspondent reports that earlier, the two police lawyers, Sokari Egop and Alibi Jonah requested the court to dismissed the suit but the court declined their request and refused to award one of them application for cost. Speaking outside the court room counsel to police Sokari Egop said the plaintiff counsel withdraw the matter having seen the errors in what she filled, noting that they are ready anytime the matter is refiled. However, lawyer to the Ikwunados, Princess Lawrence declined comments on the matter .
