The Rivers State High Court sitting in Port Harcourt has struck out case of contempt proceeding against Isacc Ogbogbula, Senator Andrew Uchendu, Sokonte Davies, APC and others filled by Igo Aguma for lack of proof of serve of the originating summon.
Our Correspondent reports that at the last adjourned date, Oru Kingsley counsel to the applicant was asked to show proof of service in today's hearing.
When the case was mentioned, counsel to the defendants, Collins Dike informed the court that up till date there was no record to show proof of service and move for an oral application that the case be strike out , since the plaintiff counsel was not in court and no information to that effect.
Mr. Dike also urged the court to award cost against the applicant for not obeying the directive of the court.
In a ruling, the Presiding Judge, Justice George Omereji struck out the case and awarded cost of fifty thousand naira against the applicants for not obeying the directive of the court.
Speaking to Journalists outside the courtroom, Collins Dike, Counsel to respondents said he urged the court to strike out the case due to an seriousness in the case by applicant.
Mr. Dike noted that there was no proof of serve on the originating summon seen in the court record.
