The Appeal Court sitting in Port Harcourt has struck out the appeal of 22 sacked Local Government Council Chairmen during 2015 election against Rivers State Government, Rivers State Independent Electoral Commission RSIEC and others.
The lead judge, Justice Tan Yusuf-Hassan in her ruling said there was no proper notice of appeal found in the record of the court as such, the case cannot be heard and struck it out.
Speaking to journalists outside the courtroom, Counsel to the third and fourth respondents which is Rivers State Government and Rivers State Independent Electoral Commission RSIEC, Echezona Etiaba said the judgement was in their favour due to preliminary objection filed.
Also speaking Counsel to the appellant Mike Wodi expressed dismay on the ruling, stating that they would get back to their client on the next line of action.
The Twenty-two Local Government Council Chairmen elected in 2015 under Chibueke Amaechi administration were removed after one month in office by Governor Nyesom Wike during his first tenure which made the affected persons approach the court to reinstate them to the office.
