Court Barred EFCC From Harassing, Intimidating, Inviting, Arresting Or Detaining Christian Ile And Others

 Rivers State High Court sitting in Port Harcourt has barred the Economic and Financial Crime Commission, EFCC; from harassing, intimidating, inviting, arresting or detaining one Christian Ile and members Onuoha family in Ubima Community Ikwerre Local Government Area of  the State.


Trail Judge, Justice Aldophus Enebeli in his judgment in a fundamental Right action by Mr Ile against EFCC, it's Zonal Head and one Ikechi Jeffrey, described as unlawful, illegal and unconstitutional the action of EFCC it's Zonal Head against the applicants in the matter that is civil in nature.

Justice Enebeli expressed concerned that EFCC which is a creation of the law, should learn to respect the law rather than been used to abuse such law, insisting that the government Anti-Graft Agency can not have diver jurisdiction in a matter that is civil in nature and are already pending in different courts.

The Judge after issuing an order of perpetual injection against the EFCC from inviting, harrasing, arresting and detaining Mr. Ile and members of Onuoha family in Ubima Community, awarded the sum of ten million naira in favour of Ile as damage contrary to two hundred and fifty Million naira demand by the applicant.

Our Correspondent reports that while applicant Counsel and that of the EFCC declined comment on the judgment, Ikechi  Jeffrey who represented himself as third respondent in the matter said he will challenge the judgment of the high court at the appeal.

Mr. Ile was first petition on the 20th January, 2016 by the third respondent,  where he was invited and detained for days and was later petition by the same man in same subject matter on the 26th of March, 2021 and was invited to the EFCC which resulted in his approach to court for enforcement of his fundamental human Rights.

Rivers State Government Targets Reduction In Gender Based Violence
