Farah's Lawyer Disappointed With Court Proceedings

 



Rivers State High Court sitting in Port Harcourt has adjourned till 23rd of June, 2022 to hear on fresh motion for bail filed by counsel to Governorship Aspirant of the Peoples Democratic Party, Farah  Dagogo on two counts of conspiracy and cultism by state government.

Trial Judge, Justice Chiwendu Nworgu gave the adjourned date after state prosecution counsel, Chidi Ekeh informed the court that his counter affidavit to the bail application was yet to be commissioned.

Counsel to Dr. Dagogo, Cosmos  Eenweluzo had in his presentation told the court that the fresh bail application follows the fact that their initial bail application at the appeal court did not scale through because the motion was not determined at the lower court before proceeding to appeal.

Justice Nworgu in his ruling after hearing from the both counsels, said the reason why fifty of evidence act 2011 sighted by the defense counsel can not stand was due to the fact that prosecution counsel has perfected the information needed and have never excused themselves from the matter on same issue of travel of witness.

Speaking to newsmen , Defense Counsel, Mr. Eenweluzo after explaining his reasons for asking the court to strike out the charges against his client, expressed disappointment over the proceedings in court.

" As lawyers we respect the decision of the Court but to say the least we are totally disappointed, you came to court you are been frustrated no business is been done one adjournment or the other, you can not prosecute him why bring him to Court in the first instance,it appears the state is satisfied with the incarceration of a member of the 3rd arms of government if not second is rather unfortunate''.


On his part, State Prosecution Counsel, Mr Ekeh explained why their witnesses were not in court.

" Well it was a case that you know,a case of the state against Honourable Farah Dagogo and it came up again for hearing today but unfortunately our witnesses are away for another matter in Abuja and so they can not attend Court that is why the hearing didn't go on,in respect to his bail application which they have filed again after they lost at Court of Appeal,we have responded and need to serve them the copy of our counter affidavit and our written address for them to respond,if they have any response.''

He expressed confidence that on the next adjourned the bail application will be heard and possibly determine.
